NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida has received the petition for declaratory statement from Shelley Nachum, Unit Owner/Petitioner, In Re: Delray Oaks Condominium Association No. 2, Inc., Docket No. 2012007072, on February 14, 2012. The petition seeks the agency's opinion as to the applicability of Section 718.111(11), Florida Statutes, as it applies to the petitioner.
Whether a unit owner or Delray Oaks Condominium Association No. 2, Inc. is responsible for sheetrock repair to damages to the interior walls of a unit caused by a water heater leak under the maintenance responsibility provision in the declaration or under Section 718.111(11), Florida Statutes.
