NOTICE IS HEREBY GIVEN that the Department of Financial Services, Division of State Fire Marshal has received the petition for declaratory statement from Concord Management, Limited, Petitioner, Assignment # 129078, filed on September 28, 2012.The petition seeks the agency's opinion as to the applicability of 2009 edition NFPA 101, 7.10.1.5.1., as it applies to the petitioner.
The Cape Morris Cove Apartments located at 110 Dolphin Fleet Circle, Daytona Beach, FL 32119. This apartment building is three stories in height and each story has four apartments that open onto a breezeway that is 14 feet wide and 33 feet long. The breezeway on the second and third floor is served by two exterior stairs; one at each end of the breezeway. There are three internally illuminated exit signs installed in the breezeway. One over each stair and one intermediate sign that is located in the middle of the breezeway. There is only one intermediate exit sign on the first floor; but there are other properties in this jurisdiction with three internally illuminated exit signs on the first floor. The apartment doors open in the direction of travel and open toward the nearest stair. The apartment doors are no more than six to 15 feet from the stairs. The exit signs are damaged by residents moving in and out of their apartments by mattresses, hutches and other large furniture. They also are an attractive nuisance to our younger residents in that they like to see how high they can jump and hit the signs. Because the signs are above the stair landing after the children jump they land on the stairs and hit the guard at the landing. Petitioner would like to remove some of the existing exit signs from the property referenced above.
