NOTICE IS HEREBY GIVEN THAT the Division of Florida Land Sales, Condominiums, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, received a Petition for Declaratory Statement In Re: Petition for Declaratory Statement has received the petition for declaratory statement from Cape Marco Property Owners Association, Inc., Docket No. 2006019339.The petition seeks the agency's opinion as to the applicability of whether Cape Marco Property Owners’ Association is a condominium association as defined by section 718.103(2), Florida Statutes, and if so, is the developer required to comply with the transfer of control provisions in section 718.301, Florida Statutes as it applies to the petitioner.
