NOTICE IS HEREBY GIVEN THAT The Building Code Administrators and Inspectors Board has issued an order disposing of the petition for declaratory statement filed by William Dumbaugh on February 14, 2007. The following is a summary of the agency's disposition of the petition:
NOTICE OF DISPOSITION The Building Code Administrators and Inspectors Board (“Board”) hereby, gives notice that it has issued a Final Order on the Petition for Declaratory Statement that was filed by William Dumbaugh. The Petition for Declaratory Statement was published on March 23, 2007, in Vol. 33, No. 12, of the F.A.W. Petitioner inquired as to the nature and scope of an exemption contained within Section 468.602, F.S., and requests that the Board issue a Declaratory Statement as to whether under Section 468.602(2), Florida Statutes, an architect or engineer can delegate the applicable inspections to a representative that is not licensed as an architect, engineer, or building inspector. The Petition came before the Board at its meeting held on June 8, 2007, in Orlando, Florida. Based upon the facts and the analysis discussed in its final order, the Board issued a declaratory statement stating, that based upon the exemption of Section 468.602(2), Florida Statutes, an architect or engineer may not delegate an inspection to a representative that is not licensed as an architect, engineer, or building inspector.
