NOTICE IS HEREBY GIVEN that on August 11, 2006, the South Florida Water Management District (SFWMD or District), received a petition for waiver from Old Plantation Water Control District, Application No. 06-0705-1, for utilization of Works or Lands of the District known as the C-12 Canal, Broward County for the proposed placement of a culvert to interconnect Old Plantation Water Control District’s (OPWCD) canal and the SFWMD C-12 Canal; Section 02, Township 51 South, Range 40 East. The petition seeks relief from subsection 40E-6.011 (4) and (6), Fla. Admin. Code, which governs the placement of permanent and/or semi-permanent above-ground facilities within 40 feet of the top of the canal bank within Works or Lands of the District.
