RULE NO: RULE TITLE
62-304.520: Indian River Lagoon TMDLs
PURPOSE AND EFFECT: The Department is initiating rulemaking to establish Total Maximum Daily Loads (TMDLs) for the main stem water segments of Indian River Lagoon and Banana River Lagoon in the Indian River Lagoon Basins Pursuant to Section 403.067(6), F.S., TMDLs must be adopted by the Secretary of the Department by rule. Chapter 62-304, F.A.C., was established as the rule chapter within which rules adopting TMDLs shall reside. The verified list for the Group 5 Indian River Lagoon basin was adopted by Secretarial Order in December 12, 2007. TMDL calculations and allocations for each waterbody or waterbody segment will be adopted by rule, by the Secretary of the Department, pursuant to Sections 120.536(1), 120.54, and 403.805, F.S. This rule has been given the following OGC case number: 08-2576 for Rule 62-304.520, F.A.C.
SUBJECT AREA TO BE ADDRESSED: TMDLs and their allocations will be established for the pollutants identified as causing the impairment for the impaired waters in the above listed basin (as indicated in the order adopting the verified list for the basin and by the direction of the Florida Legislature).
