64B16-25.170: Probable Cause Panel
PURPOSE AND EFFECT: The Board proposes the rule amendment to expand probable cause candidates.
SUMMARY: The rule amendment will expand probable cause candidates.
SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COSTS: No Statement of Estimated Regulatory Cost was prepared. The Board determined the proposed rule will not have an impact on small business.
Any person who wishes to provide information regarding a statement of estimated regulatory costs, or provide a proposal for a lower cost regulatory alternative must do so in writing within 21 days of this notice.

THE FULL TEXT OF THE PROPOSED RULE IS:

64B16-25.170 Probable Cause Panel.

(1) No change.

(2) The probable cause panel shall be composed of two (2) persons, either current or former board members of the Board appointed by the chairman of the Board. One appointee must be a current board member. The panel must include a former or current board member who is a licensed pharmacist. An appointee may be a former board member. No more than one (1) member of the panel may be a lay member. An affirmative vote of both members of the panel shall be required to find probable cause.
