NOTICE IS HEREBY GIVEN that on October 09, 2009, the Department of Environmental Protection has issued an order.
Sowell Management LLC operating at the Panama City/Bay County Airport on October 9, 2009 withdrew its petition for variance of the requirements of subsection 62-761.510(5), Table UST = E, Florida Administrative Code, to allow a one year extension of the upgrade deadline to allow the operation of the existing tanks without secondary containment. Petition was received on July 9, 2009 and was assigned OGC Case #09-3157. The notice of receipt of the petition was published in the July 24, 2009, Florida Administrative Weekly. On July 23, 2009, the Department requested additional information but did not receive any additional information. No comments were received and no order was issued.
