NOTICE IS HEREBY GIVEN that on January 28, 2010, the Florida Department of Business and Professional Regulation, Division of Hotels and Restaurants has issued an order.
The Department received a Petition for an emergency variance on January 14, 2010 for subsection 61C-4.010(7) and paragraph 61C-1.004(2)(a), Florida Administrative Code, from Cold Stone Creamery, Orlando, FL. The above referenced F.A.C. addresses the requirement that at least one accessible bathroom be provided for use by customers. They are requesting to utilize bathrooms located on the same level over 300 feet away for customers.
The variance request was published in Vol. 36, No. 05, February 5, 2010 and approval is contingent upon the petitioner ensuring the bathrooms located within the Florida Mall food court are maintained in a clean and sanitary manner and are available during all hours of operation; and install directional signage in the establishment clearly stating the location of the bathrooms.
