NOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida has declined to rule on the petition for declaratory statement filed by Wendy Casey and Ronnie Barker, president and secretary for Tierra Del mar Condominium Association, Inc. on September 03, 2010. The following is a summary of the agency's declination of the petition:
The division declined to issue a declaratory statement because a declaratory statement is a limited administrative proceeding and does not provide for investigating facts; or is not the appropriate means for determining the actions of another person; or because it cannot issue a statement unless it has competent substantial evidence to consider and which the petitioner failed to provide.
