NOTICE IS HEREBY GIVEN THAT the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Wayne Wheatley, Petitioner, In Re: Regency Towers Condominium Association, Inc., Docket No. 2011002478. The petition seeks the agency's opinion as to the applicability of Section 718.113(2), Florida Statutes as it applies to the petitioner.
Whether Regency Towers Condominium Association, Inc. may construct a meeting, exercise and recreational facility on the common elements without 75% approval of the unit owners under article 5.2(b), of the declaration and Section 718.113(2), Florida Statutes.
