NOTICE IS HEREBY GIVEN THAT Construction Industry Licensing Board has issued an order disposing of the petition for declaratory statement filed by DeMay, Inc., on June 30, 2010. The following is a summary of the agency's disposition of the petition:
The Notice of Petition for Declaratory Statement was published in Vol. 36, No. 30, of the July 30, 2010, Florida Administrative Weekly. The Board considered the Petition at a duly-noticed public meeting held on August 13, 2010. The petition requested the Board’s interpretation of Sections 489.105(3)(n) and 633.021(19), Florida Statutes, and whether a licensed underground utility contractor is authorized to install combination lines to the point of service. The Board’s Order, filed on September 7, 2010, answers the Petition for Declaratory Statement. Pursuant to Section 489.105(3)(n), Florida Statutes, an underground utility contractor is licensed to install water piping except where it is used exclusively for a fire protection system. The Board answers the question in the affirmative. The point of service, where piping is used exclusively for the fire protection system, according to the facts provided in the Petition, is the downstream side of the back-flow assembly. A certified underground utility contractor is able to install combination lines to this point of service. A contractor must be licensed pursuant to Chapter 489, Part 1, Florida Statutes, in order to install potable water lines.
