NOTICE IS HEREBY GIVEN THAT the Department of Financial Services, Division of State Fire Marshal has received the petition for declaratory statement from Tim Ippolito, on February 28, 2011, Case No.: 115451-11-FM.The petition seeks the agency's opinion as to the applicability of section 14.15, paragraphs 14.15.1 and 14.15.2 of the State of Florida specific Uniform Fire Code (NFPA 1) to an existing one and two family dwelling, as it applies to the petitioner.
Argument: Section 633.025(9), F.S., prohibits a jurisdiction from enforcing the Life Safety Code to newly constructed one and two family dwellings, but there is no mention of enforcing the Uniform Fire Code on existing one and two family dwellings. Petitioner also understands that a fire safety inspector cannot inspect the inside of a one or two family dwelling unless they are invited to do so or if the inspection meets one of the ten exceptions of Section 933.18, F.S., which for this specific request would not.
