PURPOSE:

The purpose and effect of the proposed rule amendment is to repeal rules identified during the comprehensive rule review required by Executive Order 11-211 as duplicative, unnecessarily burdensome or no longer necessary.

SUMMARY:

Rule 62-807.460 specifies the form and content of information that may be needed to supplement studies made by the applicant in support of an application for corridor certifications under the Natural Gas Pipeline Siting Act. Rule 62-870.690 specifies that failure of service or to give notice to the public or any persons entitled to receive service or notice pursuant to Chapter 62-807 may be cured by the order of the Administrative Law Judge. The rule further specifies that failure to have the notice timely published in the newspaper may be grounds for alteration of a time limitation set forth in the Act. These rules are being repealed because they are unnecessary and not essential to meeting statutory provisions. Rule 62-807.460 is incorporated by reference in Rules 62-807.480 and 62-807.610. Those rules will have to be updated to remove the reference to 62-807.460.
