PURPOSE:

To discuss proposed changes to all sections of Chapter 62-780, F.A.C., Contaminated Site Cleanup Criteria, as a result of merging Chapters 62-770 (Petroleum Contamination Site Cleanup Criteria), 62-782 (Drycleaning Solvent Cleanup Criteria), and 62-785 (Brownfields Cleanup Criteria) into the existing Chapter 62-780, F.A.C. The purpose is to achieve rule consolidation and consistency across programs, where possible, based on governing statutes. Concurrently, the Department will propose to repeal Chapters 62-770, 62-782 and 62-785, F.A.C.

SUBJECT:

Consolidation of the four current Risk-Based Corrective Action (RBCA) rule chapters into a single rule chapter that addresses the criteria and process for conducting site rehabilitation at all types of contaminated sites in Florida. The discussion will be focused on proposed procedural changes to effectuate the merging of the four RBCA rules leading to a DEP Secretarial Rule Adoption Hearing.
