Overview



	The Department of Environmental Protection announces a hearing to which all persons are invited.

DATE AND TIME:	July 8, 2013, 9:30 a.m. and continuing to August 9, 2013, as necessary. Testimony from the public will be received at specific dates, times, and locations described below.

PLACE:	Miami Airport Convention Center, Room MACC 2, located on the 2nd Floor at 711 N.W. 72nd Avenue, in Miami, Florida.

Subject:	Pursuant to the Florida Electrical Power Plant Siting Act, sections 403.501-.518, Florida Statutes, an administrative law judge will conduct a hearing to consider the environmental and other effects and any other appropriate matters regarding the certification of the proposed Florida Power & Light Company Turkey Point Units 6 & 7 Project, under application for site certification number PA 03-45A3, DOAH Case number 09-3575EPP, and DEP Office of General Counsel Case Number 09-3107. The application seeks authorization for the construction, operation, and maintenance of two 1,100 megawatt (MW) (net) nuclear electrical generating units; a laydown area; a nuclear administration building; a training building and parking area; an FPL reclaimed water treatment facility and reclaimed water pipelines; radial collector wells and delivery pipelines; an equipment barge unloading area; transmission lines and system improvements; access roads, bridges and roadway improvements; and potable water pipelines. Two sets of proposed electrical transmission line corridors associated with this facility are being evaluated in this proceeding. The Clear Sky-Turkey Point transmission line is an on-site 230 kilovolt (kV) line from the existing FPL Turkey Point substation on the Turkey Point Plant property to the proposed FPL Clear Sky substation, which also will be located on the Turkey Point Plant property. The Clear Sky-Davis and Davis-Miami transmission lines are a 230-kV line from the proposed Clear Sky substation to the existing FPL Davis substation in southeast Miami-Dade County, and another 230-kV line from the FPL Davis substation to the existing FPL Miami substation in downtown Miami just north of the Miami River. The Clear Sky-Levee #1 and #2 transmission lines are two 500-kV lines from the proposed Clear Sky substation to the FPL Levee substation (which will be expanded) in west Miami-Dade County. The Clear Sky-Pennsuco transmission line is a 230-kV line from the proposed Clear Sky substation to the existing FPL Pennsuco substation in northwest Miami-Dade County. FPL’s proposed Clear Sky-Turkey Point and Clear Sky-Davis transmission lines will be located within a corridor proposed as FPL’s “East Preferred Corridor.” The Davis-Miami transmission line will be located in either FPL’s East Preferred Corridor or an alternate corridor proposed by the City of Coral Gables and the Village of Pinecrest. The Clear Sky-Levee #1 and #2 and the Clear Sky-Pennsuco transmission lines will be located within a corridor that may include all or portions of the corridors proposed as FPL’s “West Preferred Corridor,” FPL’s “West Secondary Corridor,” or the alternate corridors proposed by the Miami-Dade Limestone Products Association (MDLPA) or the National Parks Conservation Association (NPCA). More specific information about the Project, the location of FPL’sproposed transmission line corridors, and the proposed alternate transmission line corridors, including maps, can be obtained by contacting the Siting Coordination Office at DEP at 2600 Blair Stone Rd., M.S. 5500, Tallahassee, Florida 32399-3000, (850)717-9000. Following the hearing, the administrative law judge will prepare a Recommended Order for submission to and final action by the Governor and Cabinet acting as the Siting Board. Pursuant to Section 403.508(3), F.S., parties to the proceeding shall include the applicant, the Public Service Commission, the Department of Community Affairs (now the Department of Economic Opportunity), the Fish and Wildlife Conservation Commission, the water management district, the Department of Environmental Protection, the regional planning council, local governments, and the Department of Transportation. Any party listed in Section 403.508(3)(a), F.S., other than the Department of Environmental Protection or the applicant, has waived its right to participate in these proceedings if such party failed to file a notice of its intent to be a party on or before the 90th day prior to the certification hearing. Other parties may include any person, including those persons listed herein who have failed to timely file a notice of intent to be a party, whose substantial interests are affected and being determined by the proceeding and who timely file a motion to intervene pursuant to Chapter 120, FS., and applicable rules. Intervention pursuant to this paragraph may be granted at the discretion of the designated administrative law judge and upon such conditions as he or she may prescribe any time prior to 30 days before the commencement of the certification hearing. Motions to intervene must be filed (received) with the Division of Administrative Hearings (DOAH), The DeSoto Building, 1230 Apalachee Parkway, Tallahassee, Florida 32399-1550, referencing DOAH case number 09-3575, at least 30 days prior to the date of the certification hearing. If a party is represented by an attorney, any notice of intent, motion to intervene, or other pleading should be filed electronically with DOAH using the DOAH efiling system. Any agency, including those whose properties or works are being affected pursuant to s. 403.508(3)(f), F.S., shall be made a party upon the request of the department or the applicant. The Florida Board of Trustees of the Internal Improvement Trust Fund has become a party to the proceeding. The Certification hearing may be cancelled in accordance with 403.508(6)(a) F.S.; “No earlier than 29 days prior to the conduct of the certification hearing, the department or the applicant may request that the administrative law judge cancel the certification hearing and relinquish jurisdiction to the department if all parties to the proceeding stipulate that there are no disputed issues of fact or law to be raised at the certification hearing, and if sufficient time remains for the applicant and the department to publish public notices of the cancellation of the hearing at least 3 days prior to the scheduled date of the hearing.” Members of the public who are not parties to the proceeding may offer testimony to the administrative law judge at the following times and locations during the hearing: Tuesday, July 17, 2013: Public Testimony 2:00 PM to 6:00 PM and 7:00 PM to 9:00 PM Keys Gate Golf and Country Club, Banquet Hall 2300 Palm Drive Homestead, FL 33035 Tuesday, July 23, 2013: Public Testimony 3:00 to 6:00 PM and 7:00 PM to 9:00 PM Miami Airport Convention Center Room MACC 1 711 N.W. 72nd Avenue, Miami, Florida Thursday, July 25, 2013: Public Testimony 6:30 PM to 9:00 PM Miami Airport ConventionCenter, Room MACC 1 711 N.W. 72nd Avenue, Miami, Florida
