RULE:

5J-6.005	Licensing Requirement, Commercial Telephone Seller, Salesperson, Substance Abuse Marketing Service Provider

PURPOSE:

The purpose of this rule development is to update and incorporate department forms to include security documents in compliance with Chapter 2014-147, Laws of Florida; and to establish a penalty structure for violations of the Florida Telemarketing Act consistent with others established within the department.

SUBJECT:

Updated Commercial Telephone Seller Business License Application, Telemarketing Claim Affidavit; and guidance for increasing or decreasing fines based on aggravating and mitigating factors.
