69E-121.010

Indexing, Management, and Availability of Final Orders (Repealed)

PURPOSE:

Rule 69E-121.010, F.A.C., was promulgated to comply with the previous requirement of Section 120.53, F.S., to maintain a subject matter index of agency final orders. In 2015, the Florida Legislature amended Section 120.53, F.S., to repeal this requirement and instead direct agencies to transmit their final orders to a centralized electronic database maintained by the Division of Administrative Hearings. Department of State Rule 1B-32.003, F.A.C., provides the standards and guidelines agencies must follow when transmitting final orders to the Division of Administrative Hearings. Therefore, Rule 69E-121.010, F.A.C., is no longer necessary and can be repealed.

SUMMARY:

The proposed rule will repeal Rule 69E-121.010, F.A.C., as it has been made unnecessary pursuant to Section 120.53, F.S. (2015), and Rule 1B-32.003, F.A.C.
