PURPOSE:

The purpose of this rulemaking is to align state regulatory authority with federal certification so that there is viable trade for industry stakeholders.

SUMMARY:

This rulemaking deletes unnecessary language, amends the incorporation requirement of federal rule 37 FR 8667, clarifies approved disposal methods when propagating requirements are not met; and amends rule text to replace ‘may’ with ‘shall’ to better clarify the regulatory expectations.
