PURPOSE:

The purpose and effect of this proposed rule is to amend rules identified in the Department's 2020-2021 Regulatory Plan as needing to be amended by adopting federal regulations by reference, adding aerosol cans to universal waste regulations under 40 CFR Part 273 for consistency with amended federal regulations published in the Federal Register on December 9, 2019. The streamlined universal waste rules ease regulatory burdens managing discarded aerosol cans, promote the collection and recycling of aerosol cans, and reduce the quantity of these waste entering landfills and waste to energy incinerators.
