Florida Nonprofit Security Grant Program

SPECIFIC REASONS FOR FINDING AN IMMEDIATE DANGER TO THE PUBLIC HEALTH, SAFETY OR WELFARE:

In section 2, Chapter 2023-352, Laws of Florida (L.O.F.), the Florida Legislature authorized the Division of Emergency Management (Division) to adopt emergency rules to implement a grant program benefiting nonprofit organizations that are at high risk for violent attacks or hate crimes (Program). The Program’s purpose is to provide grants that may be used to increase security and safety to nonprofit organizations including houses of worship, schools, museums, and community centers.

REASON FOR CONCLUDING THAT THE PROCEDURE IS FAIR UNDER THE CIRCUMSTANCES:

In section 2, Chapter 2023-352, L.O.F., the Legislature made a specific finding that all conditions to adopt emergency rules pursuant to s. 120.54(4), F.S., had been deemed met for purposes of implementing the Program. The emergency rulemaking process is fair under the circumstances, as it was declared so by the Legislature, and because it allows the Division to fulfill its legislative mandate to implement and administer the Program while still providing reasonable and appropriate notice.

SUMMARY:

The rule establishes the Nonprofit Security Grant Program, identifies eligible applicants, establishes processes for application submission and review, specifies terms of eligibility, and delineates other Program requirements.
