PURPOSE:

The Department is promulgating this rulemaking to delete provisions in each rule requiring the Department to evaluate the rules every four years to determine if they should be repealed.

SUMMARY:

The Pollution Response Action Contracts for the Waste Cleanup Program establishes a process for competitive procurement of multiple pollution response action contractors under a single solicitation for the Waste Cleanup Program. The Department is not modifying the competitive procurement process and is only proposing to remove provisions from each rule requiring the Department to review the rules every four years to determine if they are still needed. The Department determined that Section 287.0595, F.S., requires Chapter 62-787, F.A.C., stating that the Department shall establish, by adopting administrative rules, pollution response action contracts. As these rules are mandatory, the provisions requiring their evaluation are not needed.
