RULE:

19-3.016

Executive Director

PURPOSE:

The State Board of Administration of Florida proposes to amend Rule 19-3.016, Florida Administrative Code, to set forth the authority for the Executive Director to bring suit, file claims, or take legal action or proceedings in the name of the Board, or to defend the Board in any suit, claim, or other legal action or proceeding against the Board; and to manage, settle, and/or recover any claim or other legal action or proceeding brought by or against the Board, and to require the Executive Director to provide notice to the Trustees of the Board no less than 5 business days prior to filing a complaint in the name of the Board. There are no other rules incorporating this proposed amended rule. The proposed amendment does not have an impact on any other rules. Legislative ratification of the rule amendment is not required.

SUMMARY:

Rule 19-3.016, Florida Administrative Code, is being amended to update the delegated authority of the Executive Director regarding the State Board of Administration’s participation in legal actions.
