RULE:

62S-8.002	Definitions
62S-8.003	Project Scoring Criteria

PURPOSE:

The Department of Environmental Protection proposes amending this rule chapter to update internal references to Section 380.093, F.S., consistent with legislative amendments to Section 380.093, F.S., that took effect on July 1, 2024, and to revise the rule chapter’s use of “financially disadvantaged small community” to “community eligible for a reduced cost share,” consistent with current Section 380.093(5)(e), F.S. These amendments will maintain regulatory consistency between Chapter 62S-8, F.A.C., and Section 380.093, F.S., as well as facilitate qualification of additional communities as “communit[ies] eligible for a reduced cost share,” thereby reducing or eliminating the minimum cost share otherwise required by Section 380.093(5)(e), F.S., for projects proposed by those communities to be included in the Statewide Flooding and Sea Level Rise Resilience Plan.

SUMMARY:

These proposed rule amendments include updates to one term (“community eligible for a reduced cost share”) used throughout the rules proposed for amendment, as well as updates to multiple statutory references required to maintain consistency with Section 380.093, F.S., as amended by Chapter 2024-180, Laws of Florida, on July 1, 2024. While the Department proposed certain discretionary changes to Rule 62S-8.001, F.A.C., for development upon publication of the November 14, 2024, Notice of Development of Rulemaking in the F.A.R., the Department is not proposing any changes to that rule at this time, hence why said rule is not included in this Notice of Proposed Rule.
