PURPOSE:

Revisions to Chapter 62-524, Florida Administrative Code (F.A.C.), are being considered to ensure proper regulation of new potable water wells within delineated areas of contamination in the state of Florida. The proposed revisions add clarity to both substantive and administrative aspects of Chapter 62-524, F.A.C.

SUBJECT:

The Florida Department of Environmental Protection (Department) is reviewing proposed amendments to Florida Administrative Code, Chapter 62-524, entitled New Potable Water Well Permitting in Delineated Areas, which establishes a procedure for clearing for use of new potable water wells in delineated areas of contamination. The Department received a June 6, 2025, petition from the Florida Brownfields Association, requesting that the Department initiate rulemaking on Chapter 62-524, F.A.C., related to delineating areas of ground water contamination along with the implementation of applicable rule requirements for well location and construction, testing, permitting, and clearance requirements that would apply to new potable water wells in delineated areas.
