Utility Relocation Reimbursement Grant Program

SPECIFIC REASONS FOR FINDING AN IMMEDIATE DANGER TO THE PUBLIC HEALTH, SAFETY OR WELFARE:

Section 337.4031(6), Florida Statutes, provides, “The Department of Commerce is authorized to adopt emergency rules pursuant to s. 120.54(4) to administer and enforce the provisions of this section.”

REASON FOR CONCLUDING THAT THE PROCEDURE IS FAIR UNDER THE CIRCUMSTANCES:

The procedures are fair in that they provide equal opportunity to providers of communications services which are subject to chapter 202, Florida Statutes, to apply for reimbursement for eligible costs incurred in relocating facilities at the request of a county or municipal authority.

SUMMARY:

The rule provides the procedures, administration, and eligibility criteria for the Utility Relocation Reimbursement Grant Program.
