PURPOSE:

The proposed rule amendment is being promulgated to implement changes in the administration of the District's Waterways Assistance Program. This makes minor changes to the Waterways Assistance program rule sections: Definitions, Funds Allocation, Project Eligibility, Project Administration, Reimbursement, Small-Scale Spoil Island Restoration and Enhancement Projects, and Small-Scale Derelict Vessel Removal Projects.

SUMMARY:

The amendments proposed at this time will support the updates to the Waterways Assistance Program.  Definitions, Funds Allocation, and Project Eligibility have been updated to include man-made canals.  Language was added to other waterway related projects to incorporate percentage of match required based on a county’s population.  Language was modified to better define the property control for new and existing land-based development projects. Updated language to include a refund for the full assistance amount awarded under the agreement for when public boating restrictions are implemented within 20 years of project completion. The Assistance Program Quarterly Status Report, Project Completion Certificate, and Payment Reimbursement Request Forms have been updated.  The application forms have been updated for the Small-Scale Spoil Island Restoration and Enhancement Projects and the Small-Scale Derelict Vessel Removal Projects and will be submitted as reference materials.
