RULE:

33-401.105

Refusal of Health Care Services

PURPOSE:

The purpose and effect of the proposed rule is to promote operational efficiencies as well as health and safety within the institutions by establishing a standard and structure for all inmates who wish to refuse health care services

SUMMARY:

Rulemaking is necessary due to legislative action amending sections 945.41-49, Florida Statutes. The amended rule clarifies that the inmate’s signature on Form DC4-711A, Refusal of Health Care Services, must be witnessed by one health care staff member and acknowledged by the provider. Additionally, the inmate’s refusal to sign Form DC4-711A must be witnessed by one health care staff member, a non-health care staff member and acknowledged by the provider.
