RULE:

34-17.005	Review for Sufficiency of Allegations of Breach of Public Trust and Order of Preliminary Investigation
34-17.010	Probable Cause Determination

PURPOSE:

To make substantive changes pursuant to the factors listed in Section 120.5435(4), Florida Statutes.

SUBJECT:

Regarding Rule 34-17.005, modifying language so that the rule reflects Rule 34-5.002, which is its counterpart in the complaint rule chapter.  Regarding Rule 34-17.010, update where copies of Commission orders are sent to reflect current agency practice, and update language to reflect statutory requirements regarding the issuance of public reports.  Regarding 34-17.014, modifying language to reflect that confidential referrals against different respondents should not be consolidated.  Regarding 34-17.015 and Rule 34-17.016, adding language ensuring consistency with other rules that indicate a respondent is the only party in an ethics matter.  Also regarding Rule 34-17.016, reorganize spacing of language for sake of clarity and to reflect how spacing occurs in Rule 34-5.0171, which is its counterpart in the complaint rule chapter.  Regarding Rule 34-17.017, removing language indicating the ethics referral process is informal.
