62-40.110

Declaration and Intent

PURPOSE:

The purpose of rule development is to strike an outdated statutory reference in the rule. The Department is amending this rule as part of its rule review pursuant to s. 120.5435, F.S. The rule references a repealed statute in the text: “The Legislature has also expressed its intent, in Section 373.0395, F.S., that future growth and development planning reflect the limitations of available ground water and other water supplies.” This reference, while out of date, does not impact the implementation of the rule. Other statutes, such as those in Part VII of Chapter 373, also support the intent of this rule and will be added to the statutory authority for the laws implemented.

SUBJECT:

The proposed rule amendment will remove outdated statutory references in the declaration and intent for Chapter 62-40, the Water Resource Implementation Rule, a rule defined by section 373.019(25), F.S., and authorized in section 373.036, F.S.
