69O-125.003

Unfair Discrimination Because of Travel Plans

PURPOSE:

Rule 69O-125.003 implements certain statutes within the Unfair Insurance Trade Practices Act. The proposed changes clarify existing language and update statutory citations in accordance with the mandated review of the Office’s rules pursuant to Section 120.5435, Florida Statutes. Rule 69O-125.003 is amended to clarify under which circumstances an insurer or person authorized to engage in business in the State of Florida may issue or refuse to continue any policy, contract, or certificate of insurance of any individual based on the individual’s travel plans. It is also amended to remove obsolete language. Finally, statutory citations in the rule history are updated.
