PURPOSE:

The Department is initiating additional rulemaking to implement s. 373.4134, F.S., to establish an Environmental Resource Permit for Water Quality Enhancement Areas and authorize the creation and use of enhancement credits for specified regulatory purposes. The Department previously published a Mar. 14, 2023, “Notice of Development of Rulemaking,” with extensions on Mar. 5, 2024, and Mar. 12, 2025, for Rule 62-330.010, F.A.C., and is expanding the ongoing rulemaking to address changes to s. 373.4134, F.S., from Chapter 2024-144, L.O.F., and provisions of ER SB 848 (2026) should that become law during this rulemaking prior to adoption of final rules. This notice supplements corresponding notices of rule development to implement s. 373.4134, F.S., for rules in Chapters 62-332 and 62-4, F.A.C., to revise and establish an Environmental Resource Permit for Water Quality Enhancement Areas.

SUBJECT:

The Department is proposing to amend Chapter 62-330, F.A.C., to establish a Water Quality Enhancement Area permit under the Environmental Resource Permitting (ERP) program, amend portions of the Applicant’s Handbook Volume I, create an individual permit, create a conceptual approval permit, establish the requirements for permit applications, establish the duration of the permits, create general permit conditions for conceptual approval permits, and create forms for the application and conservation easement.
