RULE:

62S-6.009

Application of Definitions

PURPOSE:

The Division of Law Enforcement (Division) determined that Rule 62S-6.009, F.A.C., requires substantive change based upon its rule review conducted pursuant to s. 120.5435, F.S. The Division seeks to amend certain definitions to clarify terms that are used within Chapter 62S-6, F.A.C., to provide a cross-reference to s. 376.031, F.S., that defines those terms, and to remove the phrase “but not limited to."

SUMMARY:

The Division seeks to renumber and amend the define the terms "oil of any kind and in any form" and "derivatives thereof," "pesticides," "ammonia" and "derivatives thereof," and "chlorine" and "derivatives thereof" as they appear in the term "pollutant." Additionally, the Division amends the rule to provide a cross-reference to s. 376.031, F.S., for other terms that are used throughout Chapter 62S-6, F.A.C., yet are not specifically defined within Rule 62S-6.009, F.A.C. Finally, the Division seeks to amend the rule to remove the phrase “but not limited to."
