61B-21.001	Definitions and Purpose

PURPOSE:

The proposed rulemaking amends Rules 61B-21.001, 61B-21.002, and 61B-21.003. The purpose of the amendments is to implement changes to these Rules based on statutory changes to 718.501(1), F.S., which modified the Department’s jurisdiction. The Department needs to update definitions (61B-21.001), update violations (61B-21.002), and add citations (61B-21.003).

SUBJECT:

61B-21.001, 61B-21.002, and 61B-21.003 address Condominium Resolution Guidelines for Unit Owner Controlled Associations. 61B-21.001 defines “association” and “affirmative or corrective action.” 61B-21.002 identifies minor violations within the categories of budgets, elections, and reporting. 61B-21.003 includes descriptions of conduct / violations and directs assessment of penalties.
