RULE:

68D-24.003

Criteria for Establishing Boating Restricted Areas.

PURPOSE:

Section 327.46, F.S., was recently amended to expand the circumstances under which local governments may establish certain boating restricted areas. Amendments to this rule are needed to align the Commission’s criteria for establishing boating-restricted areas with those statutory changes and maintain consistency in the establishment of boating-restricted areas. Furthermore, the amendments incorporate a provision that allows consideration of gaps between adjacent boating-restricted areas when determining appropriate zone boundaries.

SUMMARY:

The proposed amendment incorporates recent statutory changes to section 327.46(1)(c)1., F.S., which now allows boating restricted areas created by ordinance to extend beyond 300 feet from a blind corner, if certain criteria are met. This rule change will provide for consistent criteria for boating restricted areas created by local government and by the Commission.
