Criteria for Approval of Ordinances

PURPOSE:

The proposed rule amendments implement the new statutory criteria outlined in section 327.46(1)(c)1., Florida Statutes, which authorizes local governments to establish boating restricted areas extending up to 1,000 feet from a confluence of water bodies presenting a blind corner when necessary to ensure safe navigation and visibility for approaching vessels. These changes provide clarity to applicants and promote consistent review of ordinance review applications.

SUMMARY:

The proposed rule amendment implements Legislative changes to section 327.46(1)(c)1., F.S., allowing boating restricted areas created by local governments to extend beyond 300 feet from a blind corner, by establishing the data and information the Commission may consider when determining whether the statutory criteria have been met.
