RULE:

33-401.701

Medical and Substance Abuse Clinical Files

PURPOSE:

The purpose and effect of the proposed rule is to provide one location for all provisions related to maintenance of and access to inmate medical and substance abuse clinical files.

SUMMARY:

The proposed rule requires the Department to keep comprehensive medical and substance abuse files on all inmates and detainees, to be used and disclosed in accordance with the Health Insurance Portability and Accountability Act Privacy Rule of 1996 (HIPAA) and Florida law; provides definitions; provides guidelines regarding access to and disclosure of medical and substance abuse records; and incorporates by reference the following forms: DC4-534, Health Care Information Request Record; DC2-913, Acknowledgement of Responsibility to Maintain Confidentiality of Medical Information; and DC1-206, Inmate Acknowledgement of Responsibility to Maintain Confidentiality of Health or Substance Abuse Information.
