69J-166.002

Mediation of Commercial Residential Property Insurance Claims

PURPOSE:

The proposed rule will establish a mediation program for resolving disputed commercial residential insurance claims to be administered by the Department. This rule will replace Rule 69J-2.002, F.A.C., which is no longer needed since the number of disputed commercial residential insurance claims being mediated through the outside vendor has significantly diminished.

SUMMARY:

The proposed rule requires insurers to notify commercial residential policyholders of their right to request mediation of their disputed claims. The rule creates procedures for a notice of the right to mediation, requesting mediation, assignment of mediators, payment for mediation, scheduling mediation conferences, and the conduct of the mediation conference.
