PURPOSE:

to establish an Environmental Resource Permit for Water Quality Enhancement Areas and authorize the creation and use of enhancement credits for specified regulatory purposes. This notice supplements corresponding notices of proposed rule to implement s. 373.4134, F.S., for rules in Chapters 62-330 and 62-4, F.A.C.

SUMMARY:

The rules will create a voluntary water quality enhancement area (WQEA) permit regulated under the Environmental Resource Permitting Program as an individual permit or a conceptual approval permit. Existing rules will be amended to add a processing fee and add WQEAs as a permit category with associated application forms and requirements and make necessary related corrections. New rules will be created to specify application and permit requirements, monitoring requirements, land use protections, and assurances for perpetual operation of the WQEA.
