PURPOSE:

The Department proposes to make clarifications to recent rule amendments in Chapter 62-210, F.A.C. In particular, the Department intends to remove references to hydrochloric acid and nitric acid in the definition of Acid Mist because EPA test method 8 does not apply to those types of acid.  In addition, the title of the referenced federal appendix in subsection 62-210.200(1), F.A.C., is to be changed from “Appendix A” to “Appendix A-4”; and the language in paragraph 62-210.370(3)(c), F.A.C., will be revised to make it clear that a Title V source may claim that using the DEP’s electronic annual operating report software is a technical or financial hardship simply by submitting DEP Form No. 62-210.900(5) to the DEP Division of Air Resource Management instead of using the reporting software.  This clarification will also be made in the corresponding instructions to DEP Form No. 62-210.900(5) Annual Operating Report for Air Pollutant Emitting Facility [Including Title V Source Emissions Fee Calculation].
