The My Safe Florida Home Program

SPECIFIC REASONS FOR FINDING AN IMMEDIATE DANGER TO THE PUBLIC HEALTH, SAFETY OR WELFARE:

The Florida Legislature found that an emergency exists in the state’s problematic property insurance market that has caused an immediate danger to the public health, safety, or welfare of the citizens of Florida. The Florida Legislature has directed the Department to adopt emergency rules in order to implement the My Safe Florida Home Program (MSFH Program) to help alleviate the danger to the public health, safety, or welfare. The MSFH Program is designed to harden eligible Floridians’ homes against wind-borne damage during hurricanes and high wind events. The Florida Legislature recognized the emergency condition and approved use of emergency rulemaking in Chapter 2022-268, Laws of Florida during the Spring 2022 special legislative session.  Therefore, the Department of Financial Services has found that there is an immediate danger to the public health, safety, or welfare of the citizens of Florida requiring emergency action.

REASON FOR CONCLUDING THAT THE PROCEDURE IS FAIR UNDER THE CIRCUMSTANCES:

This rulemaking is necessitated by the immediate danger to the public health, safety, or welfare to the citizens of Florida caused by a critical need in the state’s problematic property insurance market which requires emergency action.  The purpose of this emergency rule is to help harden eligible Floridians’ homes against wind-borne damage during hurricanes and wind events. Florida homeowners and the insurance market will benefit under the MSFH Program because the hardened homes will better withstand high winds resulting in fewer insurance claims. All statutory and administrative procedures required for the adoption of this emergency rule have been followed.

SUMMARY:

This emergency rule will implement the MSFH Program by incorporating applications and guidebooks into the rule. These applications and guidebooks will allow eligible Florida homeowners to apply for a free home hurricane inspection and for grants to perform eligible home hardening construction projects. The rule will also provide instruction to construction contractors regarding participation in the MSFH Program.
