Central Florida Water Initiative Area, Supplemental Applicant’s Handbook

PURPOSE:

The Department intends to enter rule development to amend rule 62-41.302(1), F.A.C., to update the Central Florida Water Initiative (CFWI) Area Supplemental Applicant’s Handbook to implement s. 3, ch. 2021-153, Laws of Florida, which amends section 373.0465(2)(d), F.S., to require the Department to adopt a drought allocation for supplemental irrigation for agricultural uses and a process for the applicable water management district implementing the rules to annually examine an agricultural user’s 5-year moving average supplemental irrigation water use. The rule will address agricultural users in the “Central Florida Water Initiative Area”, which includes all of Orange, Osceola, Polk, and Seminole Counties, and southern Lake County.

SUBJECT:

These rule amendments will apply only to consumptive use permits issued to agricultural users in the CFWI Area, and will address an agricultural user’s annual supplemental irrigation allocation based on a 2-in-10-year rainfall condition, including consumptive use permit conditioning and annual examinations of an agricultural user’s 5-year moving average water use against permitted allocation.
