PURPOSE:

The purpose of this rule development is to update Chapter 15A-12, F.A.C., to be consistent with §§ 322.12 and 322.0255, F.S. This rule chapter was last revised in 2011. As required by § 120.5435, F.S., and the Department's 2025-26 annual regulatory plan, the Department has reviewed this rule chapter and found that revision of the entire chapter is necessary. The revised rules define and update terms used throughout the rule chapter to be consistent with § 322.0255, F.S.; delete obsolete forms and adopt new forms consistent with the revised rules and § 322.0255, F.S.; update the rule chapter to include specific requirements for course providers of motorcycle safety courses necessary for a person to obtain a driver license authorizing operation of a motorcycle, instructors of such motorcycle safety courses, and curricula for such motorcycle safety courses; provide specificity to ensure a consistent motorcycle safety program; revise the rule chapter to comply with the requirements of the Administrative Procedure Act, Chapter 120, F.S.; reduce paperwork; and position the program to better utilize technology.
