PURPOSE:

The purpose and effect of this amendment is to update the Application for a Water Well Contractor’s License to conform to section 373.323(3)(b)(1), F.S., as amended in 2016.

SUMMARY:

Section 373.323, F.S., governs licensure of water well contractors. Pursuant to this section, Florida’s five water management districts are responsible for issuing this license to those who wish to engage in business as a water well contractor and meet the statutory requirements listed therein. 
Prior to 2016, s. 373.323(3)(b)(1), F.S., required those who wished to take the water well contractor licensure exam to demonstrate that they had at least two years of experience in constructing, repairing, or abandoning water wells by providing, among other things, a letter from a water well contractor and a letter from a water well inspector employed by a governmental agency attesting to such experience. 
In 2016, s. 373.323(3)(b)(1), F.S., was amended so that either of the two letters submitted on its own would suffice to demonstrate the requisite experience. 
Southwest Florida Water Management District’s Application for a Water Well Contractor’s License form is adopted by reference in rule 40D-3.037(5), F.A.C. The application restates the requirements imposed by Section 373.323, F.S., and currently includes outdated language. This rulemaking will amend the application by adding the word “either,” and replacing the word “and” with the word “or,” thereby conforming it to the current statutory language.
