PURPOSE:

Rulemaking is required due to the legislative amendment of sections 945.41-.48, Florida Statutes.  The proposed rules implement the statutes as amended by clarifying and updating the Department’s procedures for involuntary placement in and discharge from mental health facilities.

SUMMARY:

The proposed amendments clarify and update the Department’s procedures related to inpatient mental health treatment.  As part of these updates, the Department intends to repeal Rules 33-404.2096 and 33-404.2098, Florida Administrative Code.
