Disciplinary Guidelines

PURPOSE:

The purpose and effect is to add a table listing minor violations for which a notice of non-compliance shall be issued for a first or second violation if such violation does not result in economic harm to a person or adversely affect public welfare or create a significant risk of such harm and to update the Office of Financial Regulation Disciplinary Guidelines for Chapter 517, Florida Statutes (F.S.) and Division 69W, Florida Administrative Code (F.A.C.) (“Disciplinary Guidelines”) incorporated by reference in the rule.

SUMMARY:

The rule is amended to add a table listing minor violations for which a notice of non-compliance shall be issued for a first or second violation if such violation does not result in economic harm to a person or adversely affect public welfare or create a significant risk of such harm and to update the Office of Financial Regulation Disciplinary Guidelines for Chapter 517, Florida Statutes (F.S.) and Division 69W, Florida Administrative Code (F.A.C.) (“Disciplinary Guidelines”) incorporated by reference in the rule. The Disciplinary Guidelines are reorganized, references to notices of non-compliance are removed as a penalty throughout, violations that are rarely cited are removed, and violations with similar penalties are consolidated. Additionally, the following changes were made: branch office notice penalties were reduced, a violation of investment adviser associated person continuing education requirements was added, violations of FINRA Rules 6000 Series were added (these rules were previously incorporated by reference in OFR rules but were not added to the disciplinary guidelines), consolidated violations for Rule 69W-600.013(1)(m), F.A.C., which concerns the sale of non-compliant, non-exempt securities where the issuer of such securities has failed to comply with the reporting requirements of sections 13 or 15D of the Securities Exchange Act of 1934.
