Constitutional Amendment Initiative Petition; Submission Deadline; Signature Verification

PURPOSE:

The amendments to this rule primarily are based upon amendments to Section 100.371, Florida Statutes, in Chapter 2008-95, Laws of Florida. The amendments altered the requirements relating to the recording by the supervisors of elections and the determination by the Secretary of State regarding verified signatures on citizen constitutional initiative petition forms.

SUMMARY:

The proposed amendments to this rule delete the requirement that verified signatures be recorded in the statewide voter registration system. The revised rule adopts a paper certification system for use by the supervisors of elections in reporting signature verifications to the Secretary of State. The amended rule prescribes that the petition signatures must be verified and reported to the Division of Elections no later than 5:00 p.m. on February 1st of the year in which the general election is held in order for the signatures to be timely filed in determining whether the requisite number of signatures has been obtained for ballot position. Revocation petitions also have to be reported to the Division by the same deadline in order for the revocations to be deducted from the number of verified signatures on the corresponding initiative petition. The revised rule also deletes obsolete language.
